Terms and Conditions
These Terms and Conditions set out all of the rights and obligations which apply when we, ABCopticians supply goods to you, and by using this site, you agree to be and will be bound by these Terms and Conditions to the exclusion of all other terms and conditions (including any terms or conditions which you purports to apply under any purchase order, confirmation of order, specification or other document). Please read the following Terms and Conditions carefully before placing your order. We reserve the right to change the Terms and Conditions at any time, and your continued use of this site means you will be deemed to have accepted any such changes. All information contained in our sales literature or correspondence is provided for guidance only and do not form part of these Terms and Conditions, unless we agree otherwise with you in writing. The following definitions apply throughout the Terms and Conditions set out below and to any subsequent dealings with www.ABCopticians.ie Any references in these Terms and Conditions to “the company”, “us”, “our” or “we” refer to www.ABCopticians.ie Any references in these Terms and Conditions to “you” or “your” refer to the purchaser or user of this website. Any references in these Terms and Conditions to the ‘website’ refer to the website known as www.ABCopticians.ie General information When ordering on this site you must be over 18, not registered blind, and you must enter a prescription that is issued within two years of the order date and is issued to you by a registered optometrist or medical practitioner. When goods are ordered you will not be able to change your mind on the frames picked. In the event that you enter the wrong prescription we will not be responsible. If you enter the PD and spectacle prescription yourself we will use the information given. Where you do not enter a PD we use 62mm for distance and 58mm for near. When an order is place you agree to pay in full for the frame and lenses requested in your order whether it is verbal or through the website. You must enter your personal details correctly. We are not accountable for an errors or omissions you make on your personal details. All goods are for sale subject to availability from the manufacturer. When frames are modified we will inform you. Spectacle lenses are from a stock range of +/- 6 dioptre sphere and an opposite cyl of up to 2 dioptres. Lenses are made from CR39 material and uncoated. If you request a hard coating please note that this not a scratchproof coating. The onus is on you to take care of the complete spectacles in an adequate fashion. You are responsible for taking care of the lenses to prevent scratching. We will not accept any responsibility for scratches and wear and tear of the lenses or the frames due to your handling of the spectacles. In the event of a manufacturer’s fault in the lens or lens coating or frame please contact us. Frames and lenses are under warranty for manufacturer’s fault for one year from time of receipt of goods. We date receipt within 10 days of our postage date to you. Photographs on the website are for display purposes and match the goods as near as possible. Goods on this website are priced in Euro currency and have a 21% vat rating in Eire. We reserve the right to change these prices without prior warning. Once an order is placed we will charge you the price stated at the time of order. Prices stated do not include delivery charges. Payment can be made with Paypal. Delivery charges will be advised in the order process. DELIVERYDelivery is through An Post postal service in Ireland. If you want delivery in any other fashion please contact us. Delivery is to the address you specify on your order. Our aim is to deliver the goods as soon as possible. We stock most of the frames and lenses to ensure delivery is as quick as possible. If we are waiting for a frame or lens to arrive we will inform you of the delay. You should have your order from us within 20 working days. If you do not receive the order please let us know. In the event that the goods are lost or damaged after we post them we will not be accountable for this event. The loss of goods or failure to deliver is a matter for the delivery companies not us. We have a return address on the goods and if the come back to us we will contact you. In the event of this you are liable for any further delivery charges. If you want recorded delivery or express delivery you are liable for the extra cost. Goods damaged in transit will not be our responsibility. All goods are inspected on postage and will leave us in optimum condition. All damage is due to handling after the goods have left our care. We will not be held responsible for any refund or replacement of the goods. We will not be liable for any damage to the goods. We are not liable for any damage or loss you incur when using the goods when delivered to you and received by you. Your statutory rights are not affected by the use of the website and we declare that the material used in the website is an as is basis. ABCopticians or its employees will not be responsible or liable to you for any losses, injury, interruption of business, loss of data, loss of profit, loss of goodwill, loss of business, loss of contracts, loss of friends or family, when dealing with us. Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods or fraud or any other liability which by law we are not permitted to limit or exclude. Our total liability (including our employees, agents and subcontractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates. Nothing in these Terms and Conditions shall be taken as excluding or limiting our liability for death or personal injury resulting from our negligence or for any breach of statutory implied terms as to title of goods, which by law cannot be limited or excluded. We do not accept liability for any consequential or incidental loss (including but not limited to lost profits, loss of data or loss of privacy) or for any other indirect, special, or punitive damages whatsoever that arise out of or relate to the use of this website or the purchase or the use of any goods or services from the website. Our liability arising out of or in connection with these Terms and Conditions, whether in contract, tort or otherwise, shall in no circumstances exceed a total aggregate amount equal to the price of the goods ordered by you from us. You must observe and comply with all applicable local regulations and legislation (including without limitation, obtaining all necessary customs, import and other permits required prior to the purchase of goods from this website). The importation or exportation of certain of the goods to you may be prohibited under national law. We make no representation and accept no liability in respect of the exporting or importing of the goods. The online material at www.ABCopticians.ie does not contain any medical advice that may be relied on by you. We emphasize the importance of regular and thorough eye examinations and will not be held responsible for the negligence of an Optometrist, registered Ophthalmic Optician or registered medical practitioner from whom you receive your prescription/advice. You may have other rights granted by law including your statutory rights as a consumer and these terms do not affect those rights. Refunds and exchangesWe will only offer a refund or exchange of goods in the following circumstances in this paragraph : a. If you provided us with the correct prescription details and the goods delivered to you do not match the prescription you have provided; or b. If there is a manufacturing defect with the goods delivered to you; and have contacted us within five (5) working days of the date of the postmark on the goods packaging. c. We will only accept returned goods if they are unopened and fit for resale. Our suppliers will exchange or refund or credit us for goods that are damaged by you or opened by you. Thus we are not in a position to refund, exchange or credit you in this situation. d. We will not refund postage or packing. If you are returning goods to us you are responsible for postage and packing. Do not return goods unless you have conatcted us for a returns authorisation code. f. If you return goods to order more expensive goods or larger quantities you will have to pay the difference in price between the initial order and the new order. Please note that we inspect all goods prior to being sent to you and we will not be held liable for any damage incurred in transit by any postal company or any other third party. If you have chosen a delivery option which has insurance any claim should be taken up with the relevant postal company which provided that insurance. If you decide to return the goods to us, unless we have indicated otherwise we will not be under any obligation to refund or exchange the goods, therefore please do not return any goods unless specifically requested in writing by us to do so. |
